Hello Everyone,

I was wondering if anyone can give me any advice, i have been seperated from my wife for 16 months, also been living in another city all this time, we have no children and were married for two years, the problem is that she cannot afford a new house, she has made it clear she does not want to sell,she makes no money and is on tax credits, I'm still paying half of the mortgage since Sept of last year, full mortgage before then. She has put the house on the market (for show) but the price is too high, but, she is refusing to drop the price of the house and doing nothing to sell the property, even the estate agent is saying she will never sell that house, what can i do, I don't really want to stop paying the mortgage, I'm returning back to court on the 18th Nov but It sounds as though the judge cannot force her to do anything only advise her, she is also on legal aid, so I'm getting stung from all sides.

Please help

My husband did a similar thing with the marital home when we split 3 years ago, however my solicitor stepped in and he was forced to reduce the price to a reasonable amount, she also insisted on accompanied viewings ( either with me there or the estate agent ) to ensure he couldn't try to put people off.... maybe your solicitor could do a similar thing ?

Also assuming the house is in joint names, there is nothing to stop you using an alternative estate agent of your own and putting the house up for sale yourself, again with accompanied viewings , as there are no children involved I don't think in law your wife could stay in the property indefinitely... however you would need to seek legal advice before doing anything.

Frankie S, The 18th has come and gone. What was the result?
